FED:Wake was exceptionally courageous =2
The NSW branch of the Liberal Party, of which Wake was once a member, expressed its
heartfelt condolences to her family.
"Nancy will be remembered for her great tenacity and courage during the darkest hours
of World War II," NSW Liberal Party president Arthur Sinodinos said in a statement.
"Members of the Liberal Party will also remember Nancy as a great servant of our cause."
Wake was a member of the party's NSW executive and stood as a candidate at the historic
1949 federal election.
She contested the seat of Barton, held by the Chifley Labor government External Affairs
Minister Dr Herbert (Doc) Evatt, in the poll, which delivered victory to party leader
Robert Menzies.
She was unsuccessful but in 1951 stood against Dr Evatt - who was by then deputy opposition
leader - for the second time.
After a period living overseas, Wake later unsuccessfully contested the seat of Kingsford
Smith for the Liberals at the 1966 federal election.

Fed: RBA says housing boom appears to have stopped
Australia's central bank says the country's long-running housing boom appears to have stopped.
Reserve Bank of Australia governor IAN MACFARLANE says the boom appears to have been
followed by something which is reasonably flat.
But he says this doesn't doesn't represent a bust.
In his semi-annual parliamentary testimony Mr MACFARLANE says the chances of a housing
market bust is much lower now than if the boom had continued for another year.
Mr MACFARLANE also says he's very pleased house prices have finally begun to fall by
a small amount.
He's also pleased households are no longer borrowing at the extraordinary rate they were in 2003.

Fed:Abbott remains defiant, despite polls
HAZELMERE, PERTH, Aug 14 AAP - With one week to go before election day, Opposition
Leader Tony Abbott says he can beat an "incompetent" and "wasteful" Labor government despite
the latest opinion polls.
Mr Abbott, speaking at the head office of Barmino, a mining contractor, in the outskirts
of Perth, he said he was running against "the full might" of an incumbent government,
five Labor states and the $1 billion backing of the trade union movement.
"I am running against big money, I am running against big factions, I am running against
big politics," Mr Abbott reporters on Saturday.
"But I think we can still do it."
The latest Nielsen poll in Fairfax newspapers on Saturday put Prime Minister Julia
Gillard's Labor party ahead by 53 per cent to the coalition's 47 per cent on a two-party
preferred basis.
This was a marked turnaround from the coalition's lead of 51 per cent to 49 per cent
just a week earlier.
A Newspoll in the Weekend Australian newspaper also showed that while Labor would lose
key seats in Queensland and NSW, there was a big swing to the government in Victoria.
Mr Abbott said ousted former Labor prime minister Kevin Rudd has not been questioned
fully on where he thought Labor went wrong under his leadership and on new Labor policies
as an offshore processing centre for asylum seekers in East Timor.
"If those questions are not put, and those questions are not satisfactorily answered,
I think we can be absolutely confident that a returned Labor government, should it happen,
will be in a state of civil war between the current prime minister and the former prime
minister
"It will be hard to know if it is real Julia, or old Julia, or comeback Kev absolutely
in charge."

Fed: RBA should show caution on rates:ACCI
CANBERRA, April 6 AAP - The Reserve Bank of Australia (RBA) should show caution about
raising interest rates too quickly and not choke off early signs of economic recovery,
the Australian Chamber of Commerce and Industry said on Tuesday.
The central bank is holding its monthly board meeting on Tuesday and where a majority
of economists expect it to raise the cash rate for a second month in a row to 4.25 per
cent from 4.0 per cent.
ACCI director of economic and industry policy Greg Evans said there was still an outside
chance that the RBA won't lift rates on Tuesday.
"There is every reason for the bank to be cautious ... there is every evidence that
the economy hasn't really moved out of second gear," Mr Evans told reporters in Canberra.
"This is an economy which isn't moving necessarily in a synchronised fashion."
He said while there were positive sectors such as in mining and mining services, this
was not the overall picture of the economy.
"We certainly don't want the Reserve Bank to choke off any early signs of recovery,
which we are obviously seeing in the economy," he said.
He said the 100 basis point rise in official interest rates so far was having an impact,
particularly for smaller businesses who had seen their loan rates increase by a greater
margin than official moves.
He said if the official rate was lifted on Tuesday, there was every argument that banking
institutions shouldn't necessarily lift them by the full amount.
"Banks have increased their net interest margin so they do have the capacity within
their own balance sheets to not pass on the full official interest rate increases," he
said.

Vic: Woman who killed former partner sentenced
MELBOURNE, Feb 12 AAP - A Victorian woman, who was suffering post-natal depression
when she stabbed her former partner to death, has been sentenced to nine years in jail.
Amanda Jane Felsbourg, 22, of Moe, in the state's south-east, was found guilty last
year by a Supreme Court jury of the manslaughter of 26-year-old Wayne Laffey.
Supreme Court Justice Bernard Teague today sentenced Felsbourg to nine years in jail
with a non-parole period of six years.
The court was told that Mr Laffey was found stabbed to death on the front lawn of a
house in Keith Avenue, at Moe, on October 3, 2006.
"There were more than 30 stab wounds to his chest, arms and legs," Justice Teague said.
"Six penetrated his chest cavity causing a quick loss of blood and a quick death.
"The final stab wound had a particularly dramatic look about it.
"The knife was left upright, with the blade pinning Wayne Laffey's right hand to the ground."
The court was told that Mr Laffey and Felsbourg had had an on-off relationship since
2004, and had a daughter named Jade who was born in July 2005.
Felsbourg and Mr Laffey broke up in March 2006, but remained in contact even though
Mr Laffey had moved to Melbourne and started a new relationship with another woman, Jessica
Heslop.
In September 2006 Felsbourg and Mr Laffey began seeing each other again.
But in early October Mr Laffey decided that he wanted to return to Melbourne.
The court was told that Felsbourg became angry about a text message being sent by Ms
Heslop to Mr Laffey.
At 9.30pm on October 3, 2006, Felsbourg made three phone calls - to a friend, Triple-O
and her mother - the court was told.
"In all three calls you spoke of having killed Wayne," Justice Teague told the court.
"I am not satisfied beyond reasonable doubt that you acted out of jealousy.
"I am satisfied beyond reasonable doubt that you acted out of anger.
"I accept that at the time of killing you were suffering from post-natal depression."
Justice Teague said that he took into account when sentencing Felsbourg that she had
no prior convictions, had shown remorse, and that her prospect for rehabilitation was
excellent.

SYDNEY, Aug 25 AAP - Hardline Islamic cleric Mohammed Swaiti has forced his way back
into Canberra's only mosque to preach anti-western messages after he was sacked for praising
jihadists.
The cleric used his predominantly Palestinian and Jordanian support base to topple
the leaders in charge of Abu Bakr Mosque in Yarralumla, News Limited newspapers report.
This has allowed Sheik Swaiti to continue preaching Wahabbism -- a fundamentalist strand
of Islam espoused by Osama bin Laden.
Islamic Society of ACT president Sabrija Poskovic, whose organisation is in charge
of the mosque, said he was forced out after receiving threats from Swaiti's followers.
"They took over the mosque by force, by argument, by screaming, by calling us names,"
Mr Pokovic said. "There is no point arguing with him and his supporters anymore."
Sheik Swaiti is being investigated by the tax office for allegedly failing to pay tax
on thousands of dollars in clerical allowances he is accused of receiving from the Saudi
government.

Fed: Voters no longer interested in Hanson: Howard
AAP General News (Australia)

Fed: Voters no longer interested in Hanson: Howard
By Jade Bilowol and Nick Butterly
BRISBANE, Dec 8 AAP - Prime Minister John Howard believes Australian voters are no
longer interested in Pauline Hanson and her anti-immigration outbursts.
Mr Howard today dismissed the former One Nation leader's plans for a political comeback,
saying he believed she would be unsuccessful at next year's federal election.
Ms Hanson is unsure whether she'll run for the Senate or the lower house.
A decade after the right-wing firebrand warned Australia was in danger of being swamped
by Asians, she has now targeted "black south Africans" and Muslims.
Ms Hanson said Africans should be barred because they brought AIDS into the country.
She also said she was angered by the loss of Aussie traditions because of Muslims.
When asked if Ms Hanson would be successful again at the polls, Mr Howard replied:
"I don't think so, but that will be for the voters.
"I don't believe that people are very interested in what she is saying now," Mr Howard
told Southern Cross Broadcasting.
He said while he was critical of "zealous multiculturalism", he didn't believe people
should be singled out for their race or religion.
Other mainstream politicians were equally dismissive of Ms Hanson and her political ambitions.
Federal Human Services Minister Joe Hockey also said the public response to Ms Hanson's
initial comments that won her a federal seat in 1996 had worn off.
"I think what people need to realise is that you can come up with some superficial
words, but when you dig a little deeper and find out what her policies might be, many
Australians would disagree with them as they have at a number of polls to date," Mr Hockey
told the Seven Network.
Opposition Leader Kevin Rudd agreed, saying Ms Hanson had failed to come up with any
solutions to what she perceived as problems.
"I think Mrs Hanson has in the past always been good at identifying what she sees as
being problems but I've never seen Mrs Hanson come forward with any practical solutions
for the long-term," Mr Rudd said.
However, renegade Nationals Senator Barnaby Joyce said while he didn't necessarily
agree with her controversial views, she had "every right to say them".
"I think she's got every right to get out there and make a statement," the Queensland
Senator said.
He refused to join her political detractors and criticise her, saying he actually admired
her confidence to speak her mind.
"I think I understand totally where she's coming from when people try to get stuck
into her and that's why I'm not going to start doing it," Senator Joyce said.
However, he said Ms Hanson had to back her explosive statements up with fact.
He also disagreed with her comments that politicians criticised her because they were
envious of her publicity.
"I don't think anyone's jealous of her," Senator Joyce said.
In her five attempts at getting elected since March 1996, Ms Hanson was only successful
on the first occasion when she became the independent MP for the Queensland federal seat
of Oxley.
She failed to win the neighbouring seat of Blair in 1998 and lost two subsequent attempts
to win Queensland Senate seats.

NSW: New govt study to look at cause of pedestrian deaths
By Alyssa Braithwaite
SYDNEY, Feb 12 AAP - The NSW government will conduct a study to find out why so many
pedestrians are killed on the state's roads, as new figures reveal they account for almost
a fifth of road fatalities.
In 2005, 96 pedestrians died on NSW roads, up 11 or almost 13 per cent, from 2004,
according to NSW Roads and Traffic Authority (RTA) figures.
Many were drunk when they were struck by vehicles.
NSW Roads Minister Joe Tripodi today announced the RTA will examine why a rising number
of pedestrians were killed and injured on NSW roads and the results will be used to devise
targeted road safety programs.
"There has been a long-time trend downwards in terms of pedestrian fatalities in the
state but I'm concerned that last year there was an increase of 11 on the year before,"
Mr Tripodi told reporters in Sydney today.
"Has there been a change in pedestrian behaviour and attitudes towards cars, or have
motorists themselves changed their attitude towards pedestrians?
"These are exactly the questions I want the RTA to look into."
Over 2,300 pedestrians were injured on NSW roads in 2004, and most of the accidents
occurred on urban roads.
Mr Tripodi said the 18-month study will look at road safety across all age groups,
with children and the elderly featuring significantly in the statistics.
Children under 16 accounted for nine per cent of pedestrian deaths and 19 per cent
of injuries, while 17 per cent of injuries and 43 per cent of deaths involved people over
60 years of age.
A significant number of pedestrians involved in accidents were intoxicated at the time
and this will be examined in the study, Mr Tripodi said.
The majority of pedestrian deaths occurred in Sydney, Newcastle and Wollongong, but
21 per cent occurred on country roads where the speed limit is 80 kph or less.
"Sydney CBD is one area where there are a significant number of fatalities, but it's
a phenomenon right across the state," Mr Tripodi said.

NetVendor Announces General Availability of Collaborative Workspace 4.2; Product Receives Praise and Award From Aberdeen Group.
ATLANTA -- NetVendor, a leading provider of collaborative software solutions for manufacturers, today announced the general availability of Collaborative Workspace 4.2, part of its flagship E.MBRACE(TM) software suite.
The Collaborative Workspace component of E.MBRACE streamlines the design, sale and services associated with the production of custom-engineered products via Web-based collaboration with customers and partners. The newly released Collaborative Workspace 4.2 product includes new features and functionality that extend NetVendor's collaborative software solution E.MBRACE. Highlights of the new release include user interface enhancements, expanded search capabilities, offline capabilities dubbed "encapsulation," workflow, as well as support for more document formats. The latest release of E.MBRACE Collaborative Workspace is in deployment at Boston Gear, Stephen Gould Corporation and Teradyne Inc.
Teradyne Connection Systems (TCS) -- a division of Teradyne Inc., is evaluating Collaborative Workspace 4.2 primarily for its offline review capabilities. This encapsulation feature will enable Teradyne to share documents with customers, suppliers or employees that are not connected to the company's network and essentially work collaboratively in an offline mode via the ability to add mark-ups or comments to a wide variety of document formats. Already a user of the Sales Center component of E.MBRACE, TCS has found in Collaborative Workspace a secure, collaborative environment that will simplify the exchange of information between customer product engineers, process engineers, supplier quality engineers and new product development engineers.
"The product enhances Teradyne's ability to collaborate with our customers during the design process. Our early involvement with design engineers enables us to provide them with solutions for their next generation technology requirements," said Michael Schmidt, Manager of Information Technology, Teradyne Connection Systems. "The common framework that NetVendor's Collaborative Workspace provides will make the experience more efficient and improve customer satisfaction," he continued.
Since its inception, the Collaborative Workspace component of E.MBRACE was developed to save manufacturers time and money in the custom product design process by enabling engineers, salespeople, customers and partners to share and collaborate on many types of product related documents, such as product specification sheets, technical drawings, quality assurance plans and bills of material. There are additional collaborative features for discussions and messages, online meetings as well as event tracking and notification. In particular, new to Collaborative Workspace 4.2 is a workflow component for document routing and approval as well as ad hoc task creation.
According to Aberdeen Group Research Director Kent Allen, who is segmenting sell-side solutions into different process-specific categories or "buckets," E.MBRACE Collaborative Workspace from NetVendor was recently named by Aberdeen Group as a product worthy of their "Best of the Buckets" award. "NetVendor has developed a cost-effective solution that enables customers, partners, engineers and salespeople in geographically disparate locations - armed only with a phone and a Web browser - to discuss and approve product requirements," said Allen. "The company's expertise in collaborative design is helping it carve out a strong niche in the market for sell-side software that enables the sale of complex products online," he added.
The new version of Collaborative Workspace combined with the E.MBRACE Sales Center enables manufacturers to have engineering drawings tied into catalogs, RFQs, orders, and other elements of a sell-side e-business solution -- giving them an advantage over document management or CAD/CAM products that exist on their own.
About NetVendor Inc.
NetVendor provides collaborative software and services that streamline the engineering and sales processes for custom products -- helping manufacturers speed time-to-market, reduce costs and improve customer service. Irony upon ironies. The Campaign Against Censorship of the Internet in Britain found itself in a difficult position to say the least this week. The CACIB had run a story about another site that had been closed down, allegedly as a result of the recent case won by Dr Laurence Godfrey against Demon Internet. After connecting the two incidents, the CACIB found itself the object of the good doctor's legal advisers and its site was taken down by the ISP hosting it, Instant Web. CACIB is headed up by one Malcolm Hutty, who is also a founder and employee of Instant Web. Needless to say the CACIB site is now hosted in the US, a little trickier to reach.
Gadfly is delighted that ISPs are being targetted in such a way: there always was too much freedom on the Web, the last refuge of scoundrels. Hold on, isn't that what they say about users of the libel laws?
SYBASE TEAMS WITH SAP TO ADD MOBILE ACCESS CAPABILITIES TO SAP R/3 ENTERPRISE SOLUTIONS.
Effort Defines Mobile SAP R/3 Infrastructure, Includes Joint Development Of Customizable Apps
Sybase Inc.'s Mobile and Embedded Computing Div. is collaborating with SAP Labs Inc. to extend its e-Anywhere strategy to enable mobile access for SAP R/3 inter-enterprise business solutions. Initially, Sybase and SAP are developing customizable applications, integrating Sybase SQL Anywhere Studio's popular mobile database and synchronization technology with SAP R/3, to enable handheld or wearable Internet appliances to intelligently interoperate and interact with mySAP.com solutions.
The companies say they plan to jump-start development by providing evaluation versions of the applications free of charge, two of which are already available.
Unveiled late last month, Sybase's e-Anywhere strategy targets a range of portable computing devices, including laptops, handhelds, smart phones and intelligent appliances.
"Sybase and SAP share a common vision for empowering a large number of employees with low-cost access to their enterprise solutions -- anywhere, anytime," says Terry Stepien, general manager of Sybase's Mobile and Embedded Computing Div. "Our work with SAP extends Sybase's strengths in mobile enterprise information management to the enterprise solutions market."
"The combination of Sybase's mobile computing technology and low-cost pervasive computing devices will enable rapid next-generation application development for SAP customers within the mySAP.com product strategy," adds Robert Wenig, chief technology officer at SAP Labs. "Sybase and SAP's efforts will help jump-start the market, enabling ubiquitous deployment of mySAP.com business scenarios wherever handheld or palm-top devices are used."
Sybase and SAP are developing customizable applications for use in occasionally connected environments, such as sales, service, manufacturing and mobile computing. The first two, Cross-application Time Sheets (CATS) and Fixed Assets, were showcased at TechEd '99.
The CATS application is designed to help an organization capture critical job date and time data directly into SAP solutions to automate and improve service management. A repair person for example, could more accurately track jobs charged to a specific job, order, cost center, etc. while on the job -- automating what is often currently done by paper and pencil.
The Fixed ASsets Inventory application addresses the mobile needs of companies conducting annual inventory. The system allows the inventory- taker to record (via scan or input) such information as asset location, employee number, cost center, asset tag number, manufacturers serial number and equipment type on a handheld device, for synchronizing with the master inventory SAP files. This speeds the inventory process and greatly reduces the possibility of errors.
The cornerstone of Sybase's e-Anywhere strategy is its mobile database solution, Sybase SQL Anywhere Studio. SQL Anywhere Studio's UltraLite deployment option provides the local storage of SAP data on the end- user's handheld or embedded computing device. SQL Anywhere provides two- way enterprise server synchronization, enabling the UltraLite database on a handheld device to seamlessly receive information from and send information to the corporate SAP solution.

'The Best and Brightest' not always funniest.(Ticket)(But a fine cast and an intelligent script make this adult comedy a cut above many)
Byline: Serena Markstrom The Register-Guard
The premise of "The Best and the Brightest" is not likely to resonate all that well in Oregon, where jockeying for position in the finest private kindergartens is not an activity that consumes much parental energy.
That barrier is surmountable. Who doesn't love to laugh at rich people and their problems? Wouldn't it be fun to laugh at the pretentiousness of those who think the fate of their children is decided at the age of 5?
Maybe it would, but "The Best and the Brightest" never quite makes it clear what the target of the lampoon is. As a result, we are left with a movie with underdeveloped protagonists sporting murky motives and an ensemble cast of characters (caricatures ) who on the whole can't deliver a satire that digs deep enough to be a meaningful social commentary.
Written by Josh Shelov and Michael Jaeger and directed by Shelov, "The Best and the Brightest" opens Wednesday at the Bijou for a nine-day special engagement.
The Bijou is one of a few dozen theaters running it ahead of its intended nationwide release, said Edward Schiessl, who programs for the theater.
The independent comedy had a limited 2011 release, but according to to the film websites Internet Movie Database and Rotten Tomatoes it has not been reviewed in mainstream media.
Jeff (Neil Patrick Harris) and Sam (Bonnie Somerville) are a couple from Delaware who decide to move to New York for "one last shot at the dream." They find it difficult to enroll their daughter, Beatrice, in private school because they haven't been scheming to do so since the day she was conceived.
They seek aid from Sue (Amy Sedaris). While their situation seems hopeless, Sue takes a liking to Sam and her fiery determination.
Dressed inexplicably the whole movie in fashions from the 1990s, Sue comes up with a plan to spice up Jeff and Sam's application so they can stand out from the competition. Sue recasts Jeff, a computer programmer, as a poet - and it gets them an interview.
But Jeff and Sam have a child-care crisis when it's time to meet the school's headmistress. They have to settle for leaving their daughter with Jeff's friend Clark (Peter Serafinowicz).
Clark is a man-child living with his rich father. His hobby is frequenting sex clubs and engaging in digital dirty talk with his partners.
A semen-stained transcript of one of Clark's sessions ends up in Beatrice's application, and the headmistress finds it, creating the film's first sustained funny scene. As the prim Katharine (Jenna Stern) slowly utters its raunchy lines, the filth does indeed start to sound poetic.
The deceit gains momentum during a book club meeting. There, educated rich people analyze a whole book of Clark's "poetry," which Jeff is passing off as his own edgy work in an effort to impress the school's board members.
The film is full of plot twists and sexual humor that is more interesting than your average mainstream comedy, and it has some good performances. But it explores too many possible avenues of ridicule; it couldn't possibly develop them all, so it ends up developing none.
That leaves "The Best and the Brightest" in the awkward position of being smarter than the average mainstream comedy, but not as funny.
Maybe the movie is a commentary on how easy it is to suck seemingly good people into illicit behavior under the influence of social pressure. Or maybe the target is the aspirations of middle class folks who still seek the American Dream.
Or maybe social commentary isn't the point at all. If so, then it's just fine as a silly comedy with many absurd moments, spiced up with far wittier writing than normally hits the big screen.

The Saudi mobile market racked up strong subscriber growth last year as the Saudi Telecom Company (STC) and Etihad Etisalat (Mobily) steeled themselves for the entry of a new competitor, investment bank EFG-Hermes said in a note yesterday.
Saudi Arabia had 27 million subscribers at the end of last year - ten per cent more than EFG-Hermes had forecast, implying a market penetration level of 109 per cent. "We now expect total subscribers to reach 33.4 million in 2008, implying a penetration rate of 131 per cent, up from 113 per cent in our previous forecast," the bank said.
STC's market share fell to 64 per cent, as Mobily made ground. Newcomer Zain Saudi, which starts operations next month, was expected to have 1.3 million subscribers by the end of the year.

MONTGOMERYVILLE, Pa. -- PhotoMedex, Inc. (Nasdaq: PHMD), ("PhotoMedex") a leader in the development of proprietary excimer laser, LED light systems and skin care products for dermatological applications, today announced the signing of an Agreement and Plan of Merger (the "Agreement") among PhotoMedex, Radiancy, Inc., a privately held Delaware corporation ("Radiancy") and PHMD Merger Sub, Inc. ("Merger Sub"), a wholly owned subsidiary of PhotoMedex. Pursuant to the Agreement, Merger Sub will merge with and into Radiancy, and Radiancy will become a wholly owned subsidiary of PhotoMedex. Radiancy is a rapidly growing global direct-to-consumer and dermatological products company based in Orangeburg, N.Y. This transaction combines the strength of PhotoMedex in the professional dermatology and plastic surgery market with the global reach of Radiancy in the consumer market, and represents considerable opportunity for synergies and sales growth of each company's product portfolio.
Founded in 1998, Radiancy is a leading developer and manufacturer of home-use and professional aesthetic and dermatological devices. Radiancy sells a range of home use-devices under its proprietary brand, no!no![TM], for various indications including hair removal, acne reduction, skin rejuvenation and face lifting. Radiancy also offers a professional product line which addresses acne clearance, skin tightening, psoriasis care and hair removal sold to physician clinics and spas. Radiancy posted total revenues of approximately $96 million and adjusted net income of approximately $25 million for the 12 months ended March 31, 2011. Radiancy's family of products are based on its proprietary, patent-protected LHE[TM] (Light Heat Energy) and Thermicon[TM] technologies, and are sold under the no!no![TM] brand for consumers and the Radiancy[TM] brand for professionals. The no!no! brand is available at high-end retailers such as Neiman Marcus, Henri Bendel, Planet Beauty, Selfridges, Harrods, Falavella, Fravega, Garbarino, Boots, Myers and others; home shopping channels such as HSN and QVC, online retailers such as Amazon, Dermadoctor.com, and Drugstore.com, and via direct-to-consumer advertisement that includes infomercials, commercials, catalog and internet-based marketing campaigns. Radiancy utilizes direct sales channels in the U.S., Canada, the U.K., France, Argentina, Spain, Portugal, and Israel and leading distributors in Japan, Australia, New Zealand, Singapore, Russia, South Africa, various South American countries and the Middle East.
Commenting on the agreement, Dennis McGrath, PhotoMedex president and chief executive officer, said, "This is a transformative transaction for PhotoMedex, and the combination of these two companies holds potential for revenue and earnings growth that neither one of us would be able to achieve alone. This business combination is a wonderful sales channel match, as Radiancy's professional products can benefit from PhotoMedex's direct sales force strength in the medical dermatology marketplace, honed by our many years of XTRAC[R] sales for the treatment of psoriasis and our NEOVA[TM] skin rejuvenation products. At the same time, our consumer products will be well-served by Radiancy's highly successful direct-to-consumer sales engine and skillfully creative marketing programs. Yet beyond the business synergies, we believe this is an excellent fit of corporate cultures, with a shared commitment to innovation, product quality and meeting the evolving needs of customers."
Dr. Dolev Rafaeli, president and chief executive officer of Radiancy, said, "We are delighted to be joining forces with PhotoMedex to the future benefit of both companies. We believe that Radiancy is the only professional aesthetic dermatology company that has succeeded in taking these professional technologies geared toward physicians and medical spas and adapting them for the home-use market. PhotoMedex has a number of products and proprietary technologies that may be repackaged for the consumer marketplace. Additionally, the PhotoMedex domestic U.S. sales infrastructure can give our professional-use products the attention they deserve in multiple sales channels. The timing of this transaction is ideal as Radiancy has recently expanded its reach into the U.S. and European markets, and plans to introduce a number of new products, particularly in Europe where PhotoMedex has established subsidiary operations lending itself to accelerating its market penetration."
Financial Terms and Pro Forma Financials
Under the terms of the agreement, PhotoMedex will issue approximately 14.5 million shares of common stock to Radiancy shareholders. PhotoMedex will issue to its shareholders approximately 846,000 warrants having an exercise price of $20 per share and a three-year life. If, however, the company's common stock trades at or above $30 per share for 20 consecutive trading days, then the warrants, if not exercised, may expire after notice from the company. In addition, Radiancy will contribute cash, which will be used in part to fully exercise PhotoMedex' option on the repurchase of all secured convertible promissory notes which are held by Perseus Partners VII, L.P. and which have an aggregate principal and accrued interest amount at June 30, 2011 of $22.4 million, but depending on the time of payment, can be repurchased at a discount to the principal and accrued interest. Further terms of this Repurchase Agreement may be found on Form 8-K filed by PhotoMedex with the Securities and Exchange Commission ("SEC") on June 3, 2011.
Upon consummation of the transaction and assuming warrants and options deemed by the parties to be equivalent in the transaction to issued common stock are fully exercised or converted, it is expected that there would be approximately 19.2 million shares outstanding in the company. After exercise or conversion of the deemed PhotoMedex common stock equivalents, PhotoMedex shareholders would own approximately 25% of the company and Radiancy shareholders would own approximately 75%.
On a pro forma basis, the combined company had revenue for the 12 months ended March 31, 2011 of approximately $132 million, a gross margin of nearly 70%, operating income of approximately $19 million and adjusted net income of approximately $26 million.
Non-GAAP Measures
To supplement PhotoMedex's consolidated financial statements presented in accordance with GAAP as filed with the SEC on Forms 10-K and 10-Q for the relevant periods, PhotoMedex provides certain non-GAAP measures of financial performance. These non-GAAP measures include non-GAAP adjusted net income.
PhotoMedex's reference to these non-GAAP measures should be considered in addition to results prepared under current accounting standards, but are not a substitute for, nor superior to, GAAP results. These non-GAAP measures are provided to enhance investors' overall understanding of PhotoMedex's current financial performance and to provide further information for comparative purposes.
Specifically, PhotoMedex believes the non-GAAP measures provide useful information to both management and investors by isolating certain expenses, gains and losses that may not be indicative of its core operating results and business outlook. In addition, PhotoMedex believes non-GAAP measures that exclude stock-based compensation expense and other non-cash or non-recurring expenses enhance the comparability of results against prior periods. The table below does not make acquisition-related adjustments. Reconciliation to the most directly comparable GAAP measure of all non-GAAP measures included in this press release is as follows:
| Results for the last 12 months ended March 31, 2011 ($ 000's; unaudited) | ||||||

Stockholder Approval
In connection with the transaction, PhotoMedex will file with the SEC a registration statement on Form S-4 (the "Registration Statement") to register the securities of PhotoMedex to be issued to the security holders of Radiancy and PhotoMedex. The Registration Statement will include a joint proxy statement/prospectus, which will be sent to the stockholders of Radiancy as well as PhotoMedex seeking their approval of, among other things, the merger. The consummation of the merger is subject to the review and the declaration of effectiveness of the Registration Statement by the SEC, clearance under the Hart-Scott-Rodino Antitrust Improvements Act, the approval of the merger by Radiancy stockholders and PhotoMedex stockholders, and other customary closing conditions.
The boards of directors of PhotoMedex and Radiancy have approved the transaction. The majority of Radiancy shareholders and shareholders representing approximately 46% of the common stock of PhotoMedex have agreed to vote their shares in favor of the merger, which is currently expected to close in the fourth quarter of 2011.
Leadership and Facilities
Following completion of this transaction, Dr. Dolev Rafaeli will serve as chief executive officer and Dennis McGrath will hold the positions of president and chief financial officer of PhotoMedex. The new reconstituted, nine-member board of directors of PhotoMedex will include six representatives from Radiancy including Dr. Rafaeli, and three representatives from PhotoMedex including Mr. McGrath.
The company will retain the name "PhotoMedex" and will maintain its corporate headquarters in Montgomeryville, Pa., with North American consumer sales, marketing and customer support facility in Orangeburg, N.Y. and clinical, R&D, operations, and a sales and marketing facility in Hod Hasharon, Israel. Shares in the company will trade on the NASDAQ Stock Market under the ticker symbol "PHMD."

Two Global 360 Customers Selected as Finalists in 2011 Global Awards for Excellence in Adaptive Case Management.
Dallas, TX (PRWEB) June 14, 2011
Global 360, a leading provider of process and case management solutions, today announced that two of its customers, the Los Angeles County Information Systems Advisory Body (ISAB) and the Pinellas County Clerk of the Circuit Court, have been selected as finalists for the 2011 Global Awards for Excellence in Adaptive Case Management. Co-sponsored by the Workflow Management Coalition (WfMC) and KM World magazine, these awards recognize user organizations that have demonstrably excelled in implementing innovative adaptive case management (ACM) solutions.
In response to the State of California passing Proposition 69, the "DNA Fingerprint Unsolved Crime and Innocence Protection Act," Los Angeles County ISAB implemented a centralized, web-based DNA Offender Tracking System (DOTS) using Global 360's case management solution as the application platform. DOTS helps ensure that DNA collection processes are consistent with legislative mandates so that the DNA may be utilized as evidence to support conviction and exoneration of persons accused of crimes. DOTS also aids in solving current and cold cases by increasing the population of DNA profiles in the FBI's CODIS database.
DOTS also enabled Los Angeles County ISAB to:
* Gain visibility and control over the third largest DNA database in the world
* Triple the DNA collection rate
* Save Los Angeles County law enforcement staff around 20 minutes for every DNA collection case they process. With Los Angeles County processing more than 1,200 criminal arrests every day, the result is an additional 400 hours of time a day that personnel can spend on other value-added activities.
* Track collections that enable payment from a state-provided reimbursement fund for every collection made. With each collection costing around $40 and an average 7,465 DNA samples collected every month, this automated payment method ensures that local law enforcement agencies quickly recover almost $300,000 in expenses every month with little to no manual effort.
Ali Farahani, Director, Integration Services, Los Angeles County ISAB, said, "Global 360's case management solution is the primary reason we have been successful with DOTS. It has a very clean design and a nice architecture. If you have to integrate with other products, Global 360's case management solution has one of the best APIs I have seen in any product and has great documentation. Our implementation has been very successful, deploying in a very short time. We received excellent support from Global 360."

The Pinellas County Clerk of the Circuit Court uses Global 360's case management solution to support them in creating a 'paperless' office and streamlining the processing of court cases, including making all court files and their supporting documents electronically available to the entire Pinellas County judicial system and the public.
Global 360's case management solution also enables Pinellas County to:
* Comply with the State of Florida legislative mandate requiring them to support e-filing and make records publicly available via the Internet
* Go 'green' and eliminate the need to handle, file, and route court files and paper documents, resulting in an annual savings potential in the millions of dollars
* Improve information access, which has reduced lost or misplaced documents and files and improved collaboration and decision making
* Decrease case retrieval time from days to seconds via robust search and retrieve functions
* Gain better visibility and productivity across the legal system through workload balancing and audit trails that meet operational and governance requirements
Ken Burke, Clerk of the Circuit Court, Pinellas County, said, "Global 360 has changed the way work gets done at the Pinellas County Clerk of the Circuit Court's office by making us more efficient and more effective."

Award finalists were selected by a panel of judges drawn from experts in the ACM field. ACM Award winners will be announced at a special virtual awards ceremony on June 22 at the ACMLive two-day online summit.

[x+1]'s New Research Gives Credit Card, Auto Insurance Marketers a Window into Consumer Purchase Behavior.
Research shows how message influence evolves as consumers move through the purchase funnel; also validates strength of online channel
NEW YORK -- Online targeting platform leader [x+1], www.xplusone.com, today announced a new research initiative designed to help marketers in select industries reach consumers more effectively as they move through the purchase funnel. Preliminary results show online to be the preferred channel for consumers in the market for auto insurance and credit cards.
The research will enable [x+1] to provide its clients with insights to better align their messaging with purchase behavior as consumers progress through the decision funnel stages of awareness, intent, consideration and conversion. The research is expected to address a gap in available syndicated resources for marketers.
The initial focus will be credit cards and auto insurance, capitalizing on [x+1]'s client expertise in both industries and will be based on a rolling survey of 200 U.S. consumers conducted biweekly.
The research will help clients refine their customer acquisition strategies by:
* Understanding "in market" behavior bysizing the number of consumers "actively looking" and those "open to attractive offers."
* Market segmentation insights into how communication messaging resonates at different points in the purchase decision process.
* An examination of brand perception and its impact on online purchase behavior.
"To keep their competitive edge, marketers need a constant flow of information that can help them gain a deeper view into what types of products and services consumers are looking for, how they're looking for them and why," said Leon Zemel, Chief Analytics Officer for [x+1]. "This new proprietary research from [x+1] provides insights that will help our clients 'check the pulse' of consumers' purchase behavior and what they respond to. The snapshots of intent, consideration and attitudes these results provide will help marketers looking to improve their online strategies anticipate and meet consumer needs while also fueling greater sales results."
According to initial research results from [x+1], one-third of respondents who were considering auto insurance said they visited a comparison website, while 40% said they went directly to the company website. Of those in market for auto insurance, 43% said they used an online search engine. This validates consumers' active use of the Internet channel as a research tool for auto insurance.
For the credit card industry, the results were even more compelling. MPSTOR Frees Data Centers from Proprietary Storage Systems with New MPStackware Support for the OpenStack Cloud Operating System.
In a move that drives flexibility, giving data centers the freedom to migrate away from proprietary and expensive enterprise storage systems, MPSTOR (http://www.mpstor.com/) announced its popular open-platform storage management software MPStackware™ now supports the OpenStack™ data center operating system (OS).
"We made a strategic decision to focus on data center automation," said William Oppermann, MPSTOR founder. "The momentum behind open source and open standards to build public and private clouds is clearly growing as demonstrated by the strong industry support for OpenStack. Our customers can now use our MPStackware running under the OpenStack OS to deploy a full data center solution, regaining the flexibility and cost savings lost through the use of proprietary platforms that cannot be easily expanded or upgraded."
MPStackware is now available with optional software modules under the OpenStack Apache 2.0 license which integrates the OpenStack Nova (compute) and OpenStack Swift (object store) frameworks. The new MPStackware modules provide automatic volume provisioning for virtual machines and a common management database framework for billing, support, maintenance and operations. Cork Internet eXchange (CIX), a leading Irish data center, plans to launch an Infrastructure-as-a-Service offering, based on the MPStackware, OpenStack solution.
"With this open-platform and open-API architecture solution, we see advantages in being able to elastically scale our infrastructure as our business grows while retaining the flexibility to purchase incremental hardware needs from a variety of suppliers," said Jerry Sweeney, managing director of CIX. "We also see great potential for improving operational efficiencies in our data center through leveraging the software's ability to automate the provisioning and tiering of storage." About MPSTOR Located in Cork, Ireland, privately held MPSTOR is a designer and supplier of data storage management software and solutions targeted for Cloud, Video, Telecommunications and other enterprise storage applications.
